  • Correction: there was a print-error in the recent program guide for last week's Advocis Estate Planning Summit that stated that this was the '10th Annual' event. This was incorrect and should have read '3rd Bi-Annual'.

Here is what your chapter has been up to recently:

  • The 2022 Estate Planning Summit was held on October 20th at the beautiful Paradox Hotel. Between those in-person and those who attended virtually, over 300 people took part in this premier event for all those in the estate planning field!
  • There were incredibly educational presentations from our 12 speakers, where attendees could sharpen their skills and expand their repertoire on many different components of estate planning.
  • A humongous thank you to all of our event sponsors, presenters, attendees, our awesome exhibitors, event staff and the Paradox hotel for providing an unparalleled venue.

Three ways to unlock a locked-in retirement account (LIRA)

Most advisors are aware of the two common ways to unlock all your pension money out of a LIRA prior to age 55. These are known as:

1. Access to small amounts
If the LIRA balance is less than 20% of the Yearly Maximum Pensionable Earnings (YMPE), it can be unlocked. For the year 2022, the YMPE is $64,900. This means that any LIRAs with less than $12,980 can be unlocked. (There can be some slight variations due to the different provinces’ pension rules.)

2. Shortened life expectancy
If you have a terminal illness or a disability that is expected to shorten your life considerably, then the LIRA or LIF may be unlocked. Most pension jurisdiction will require a doctor to provide the shortened life opinion in writing as well as a spouse’s consent to unlock the pension funds. But…. Did you know…

3. Becoming a non-resident of Canada
If the Canada Revenue Agency (CRA) determines that you are a non-resident of Canada for tax purposes, and confirms this in writing, then you may unlock your LIRA or LIF. Most pension jurisdictions will require 2 years of non-residency before unlocking the pension is allowed.

Taxation still applies on withdrawals regardless of how you have unlocked your LIRA!
